What to Consider Before Taking a Dispute to Court
Court proceedings are not the only way to resolve a dispute, and are not always the fastest or most cost-effective. Before commencing litigation, it is worth considering the strength of the underlying claim, the cost and time a case is likely to take, and whether the other party has the means to satisfy a judgment if one is obtained.
Alternative routes, negotiation, mediation or arbitration, can resolve a dispute more quickly and with less cost than a full trial, and are worth exploring even where litigation remains an option in reserve.
Where litigation is the right course, an early, honest assessment of the merits of the claim helps set realistic expectations from the outset, rather than partway through proceedings.
Whichever route is chosen, documenting the dispute properly, correspondence, contracts and relevant records, from the earliest stage strengthens a party's position regardless of how the matter is ultimately resolved.
